Welcome to TMRW. These Terms of Use ("Terms") govern your access to and use of the TMRW mobile application ("App") operated by TMRW ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements.
To use the App, you must create an account using Apple Sign In, Google Sign In, or another authentication method we provide. You are responsible for:
We reserve the right to suspend or terminate your account at any time for violation of these Terms.
Subscription Plans. TMRW offers subscription plans that unlock access to core features including letter writing, AI conversations, and milestone tracking. Details of available plans and pricing are displayed within the App.
Billing. All subscriptions are billed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase. By subscribing, you agree to Apple's terms of service for in-app purchases.
Auto-Renewal. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
Managing Subscriptions. You can manage or cancel your subscription at any time through your Apple ID account settings or the Settings app on your device. Cancellation takes effect at the end of the current billing period.
Refunds. All purchases are final and non-refundable, except as required by applicable law or as otherwise determined by Apple's refund policies. To request a refund, contact Apple Support directly.
Free Trial. If we offer a free trial, it will be specified at the time of subscription. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription.
Your Content. You retain ownership of all content you create within the App, including letters, conversation messages, milestones, and profile information ("User Content").
License Grant. By submitting User Content, you grant us a limited, non-exclusive, worldwide license to use, process, store, and transmit your User Content solely for the purpose of providing and improving the App's services, including sending your content to AI providers for processing.
Content Restrictions. You agree not to submit User Content that:
Nature of AI Responses. The App uses artificial intelligence to generate conversational responses, detect milestones, and analyze sentiment in your writing. AI responses are generated automatically and are not reviewed by humans.
Not Professional Advice. AI responses are intended for personal reflection and encouragement only. They do not constitute medical, psychological, therapeutic, or professional advice of any kind. The AI companion is not a therapist, counselor, or healthcare provider.
No Guarantee of Accuracy. AI-generated content may be inaccurate, incomplete, or inappropriate. We do not guarantee the accuracy, reliability, or suitability of any AI-generated content.
Emergency Situations. The App is not designed to handle crisis or emergency situations. If you are experiencing a mental health crisis, suicidal thoughts, or any emergency, please contact your local emergency services, call 988 (Suicide & Crisis Lifeline in the US), or go to your nearest emergency room.
You agree to use the App only for its intended purposes. You shall not:
The App, including its design, features, code, graphics, logos, and all related intellectual property, is owned by TMRW and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
The TMRW name, logo, and all related marks are trademarks of TMRW. You may not use these marks without our prior written consent.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
AS-IS BASIS. THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
NO WARRANTY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
AI DISCLAIMER. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR USEFULNESS OF AI-GENERATED CONTENT. YOU ACKNOWLEDGE THAT AI RESPONSES ARE ALGORITHMICALLY GENERATED AND MAY CONTAIN ERRORS OR INAPPROPRIATE CONTENT.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TMRW, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $50, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless TMRW and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your User Content, or your violation of these Terms.
App Changes. We reserve the right to modify, suspend, or discontinue the App (or any features thereof) at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
Terms Changes. We may revise these Terms from time to time. Material changes will be communicated through the App or by other appropriate means. Your continued use of the App after such changes constitutes acceptance of the revised Terms.
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and TMRW regarding the App.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
Assignment. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
